Therefore Diamond Corporation, South Africa™ subscribe to the principles outlined in Section 51 of the Electronic Communication and Transactions Act 2002 that governs the right to having personal information kept private.

  9. the name of the individual where it appears with other personal information relating to the individual or where the disclosure of the name itself would reveal information about the individual, but excludes information about an individual who has been dead for more than 20 years.

This personal information may also include any other identifiable private information which any of the parties above have provided to Diamond Corporation, South Africa™ over the Internet or any other communication channel.

Diamond Corporation, South Africa™ will regard the privacy of Diamond Corporation, South Africa™ itself, clients and/or business partners to the highest level and will only use the personal information as appropriate in the normal course of business to provide products and services the above mentioned parties have requested. This personal information will also be used by Diamond Corporation, South Africa™ to help positively identify an individual, be it client or business partner, where the previously mentioned are contacting Diamond Corporation, South Africa™ through the Internet or other communication channels.

Clients or business Partners will have the right to request the sight of and copies of any corresponding records Diamond Corporation, South Africa™ keep with the respective client and/or business partner, on the provision Diamond Corporation, South Africa™ is given reasonable notice in writing of such a request.

Clients and business partners will be requested by Diamond Corporation, South Africa™ to retain copies of any literature issued by Diamond Corporation, South Africa™ in relation to the provision of Diamond Corporation, South Africa™'s products and services. Where appropriate, Diamond Corporation, South Africa™ shall issue clients and/or business partners with appropriate written information, hand-outs or copies or records as part of an agreed contract, for the benefit of both parties.

Diamond Corporation, South Africa™ will not be held responsible for any loss resulting from clients and/or business partners distributing their personal information via the communication tools provided by Diamond Corporation, South Africa™ which is available to the general public. Clients and/or business partners will at all times be requested by Diamond Corporation, South Africa™ to refrain from using any form of language which is considered offensive, racist, or defamatory and Diamond Corporation, South Africa™ reserves the right to end the contract of any client and/or business partner, without prior notice, who fails to adhere to the requirements as set out in this Privacy Policy.

Diamond Corporation, South Africa™ reserves the right to terminate the contract agreement of any client and/or business partner, and delete the any information or material which is made available to Diamond Corporation, South Africa™. Furthermore, Diamond Corporation, South Africa™ may prevent the client and/or business partner from using or accessing products and services provided by Diamond Corporation, South Africa™ in the future, for whatever reason is deemed appropriate, without notice.

Clients and/or business partners are at all times solely responsible for any content they provide through the communication tools provided to Diamond Corporation, South Africa™ which will be available to the general public, including, but not limited to:

  1. text;
  2. photographs;
  3. messages; and
  4. any other content.

Diamond Corporation, South Africa™ strictly prohibits the usage and distribution of content which violates another party's intellectual property rights. Should Diamond Corporation, South Africa™ become aware of such intellectual property rights infringements, Diamond Corporation, South Africa™ will take the necessary steps to remove such content and ensure the correct legal are taken against the individual who was associated with the infringement.

Diamond Corporation, South Africa™ at its sole discretion, reserves the right to review and if necessary, remove any content received from clients and/or business partners for any reason, this includes but is not limited to content that violates the Diamond Corporation, South Africa™'s policies, content which is offensive or illegal or otherwise threatens the rights of other clients and/or business partners.

The personal information provided to Diamond Corporation, South Africa™ will be protected and therefore reasonable steps will be taken to protect the information from loss, misuse, or unauthorised alterations. The information Diamond Corporation, South Africa™ maintains concerning the clients and/or business partners is stored in a database that has built-in security to ensure the privacy and confidentiality of that information.

Diamond Corporation, South Africa™ will commit itself to make use of state of the art technology to prevent any unauthorised to personal information when communication and transactions are done via one of the selected communication channels. Diamond Corporation, South Africa™ will ensure that communications received from clients and/or business partners are adequately secured and protected at all times.

Diamond Corporation, South Africa™ will provide communication tools via, including, but not limited to:

  1. the Internet; and
  2. other communication channels as provided by Diamond Corporation, South Africa™.

The aforementioned tools may be used by clients and/or business partners to access their respective personal information, or to transact information which will require an access number, user name and password to validate the individual's identification and to enable access to a secured environment.

Clients and/or business partners are responsible for maintaining their password security. Their respective account and any other information that is provided by them must be kept up to date and must be protected by themselves as far as possible. Diamond Corporation, South Africa™ will not be held accountable for the client’s and/or business partner's negligence of the aforementioned information. The client and/or business partner will agree that Diamond Corporation, South Africa™, any of its subsidiaries, affiliates, employees or any other related party, will not be held accountable for any loss, damage, cost or expense incurred by the client and/or business partner relating to the use of Diamond Corporation, South Africa™â€™s communication tools. Diamond Corporation, South Africa™ will respond, as far as possible, to any enquiries or requests for information that is received from the various communication channels.
